An analogy might be useful. I build myself a house according to the council's building regulations.
Just t as I am about to move in I am told I can't, because the garden is not big enough, according to a clause in a regulation that was introduced as I was putting finishing touches to the roof.
Council says that I am free to build a house elsewhere, so I am not entitled to compensation.
