The registering company would not know - by "out of date", I mean that the new owners did not change the tech contact. What you see in a whois lookup is "up to date" according to the official records, but it is those record that are wrong.
Having managed a number of domains myself, I can understand how they could have overlooked this.
If you really wanted to stir trouble, you could report them for not having correct registration details, but it wouldn't achieve much other than make them update it.
