    Section 12? of the US Code? It deals with Banks and Banking. Perhaps you are referring to the 12th Amendment to the US Constitution? If so, this provides for a clear distinction between choosing the president elect and the vice president elect. It also provides for a contingent election via the house in the event that no candidate meets the EC majority threshold (which is now 270).

    There is nothing there about the current VP having the discretion to decide which electoral slates to accept or reject. Not that I could discern in any case. However, any research in (for example congressional research papers or even the national archives etc) indicate that to take any vagaries out of the equation, the Electoral Count ACT of 1877, which has largely now been captured within 3 USC makes it very clear as to which electoral slates are valid and under what conditions. It is very prescriptive on the Electoral College counting process and the lead up to it. If you read this and/or the myriad of analysis of this, you will see that January 6th will be ceremonial unless Democrats turn on Biden. Little doubt that Retrumplicans can and will make it theatrical....but with no effect on the outcome.
