Sorry, I didn't explain myself clearly. The approach I am querying is essentially a negotiated settlement. The parties could, say, put together a deed whereby Asset sell the title back to the Government in exchange for consideration and withdrawing their claim?
I am still not convinced the ALP "win" if they take the court case to the finish and get a pasting. The effect of pushing the case to the end, and losing, is that Madeleine King will be duty bound to approve the application given Scomo's reasons for declining will have been found to be without merit. I understand that the ALP gets polictical benefits by burning Scomo but it could come at a price and I am continually drawn back to Madeleine King's comments in August where she suggested the ALP would seek a legal solution.
