OK, so I take your word it's an admin argument not a merit argument. Wouldn't a second decline at JA level for the same reasons just end up in a new claim? Maybe Asset are better of arguing those now, especially the Force Majeure reason? Seems crazy to fight to get the application back to NOPTA/JA and then end up back in court again.
