Money does weird things to people. When someone can see huge dollars about to be made, they will often try and take them to court to get in on the action. It's horrible, but as you mention - if something was going to be a flop, no one would bother seeking funds/legal action.
Update: No selling into 2.9c anymore... Patience needed now; eventually people will start chewing into 3c; its sooooo oversold now!
