As some have referred to why RP/Genorah had not used the community status issue in court I would appreciate comment from the lawyers here.

Could it actually be better for Genorah that this was not raised as now the "new information" can be submitted in an appeal.

Beng. have had the decision in their favour, but does that mean that they no have no further recourse to the courts if in fact on appeal the RP are considered then to have the rights over "E"?
