re: tax losses and the ato - [intent] Let the tax department decide - oh wait they need to tets in court before they can issue ruling

Latest approach - fund the taxpayer against the tax office free of charge to test the legal status of it then they can go from there - imagine that the tax office funds youre legal fees to challange youre claim in court. If they win you pay the tax - if they dont win you get court costs paid and keep youre tax slice and they get a decision.

Win win unless you lose then its only youre tax payment.
