"this time it's not exactly the same" (9 lives motto for the charts)
Last time the H&S broke the SP gapped down and kept on going. When the second H&S broke yesterday we saw a gap down again on a high volume day....not a good look.
But as BHP had a good night in the US you would have to back it for an up day today. That said the overall picture still looks rather tacky. BHP would need to break and close above $36 (the neckline) on decent volume to convince me this is something more than a gap closing exercise.
