It seemed reasonably clear from the case that; the coal sold was intentionally mined for sale, with BRL making deliberate choices as to where the coal was mined from - to optimise volumes and minimise mining costs. They were mining, not undertaking construction - and it would seem that the decisions to mine had nothing to do with Hamish.
