That folks, is 30% - 70% distribution to weep over.
With 70% of of our blood money in their silk-lined pockets,
it is more than apropriate to reinstate this text:

Hello xxxxxx,

I feel, although the class action is finalised, that the applicants'
legal representative would have been privy to the order, and particularly
to paragraph 6 which I interpret as being open to conjecture.
It states in part:-
The Court has not been asked to determine what caused the Fund to fail,
although had the case run to trial it would undoubtedly have been required
to do so.
At this stage one can at least say that the potential candidates include:

i) illegal or fraudulent behaviour by some of those involved in its management;
(ii) bad investment decisions;
(iii) the credit crisis; or
(iv) a combination of one or more of the above.

These reasons will not resolve that debate.
But the short list provided above does afford valuable context
in the process of considering the extent of Ms Waters'
and KPMG's liability for what occurred.

The operative “ has not ” as opposed to “ cannot ” seems to imply that
this path is still open to scrutiny.
However, not being versed in legal jargon my feeling in plain English
is that further examination of this unsettling concurring opinion warrants
sagacious questions that could lead to the truths which brought the downfall of this fund.
