flashman1207, I am not a holder (nor trader) of MMX but I have a vested interest in the Midwest. The outcome of this case may or may not affect my interests. I dare say though I believe it won't apart from speculation.
MMX have made rather basic errors in judgement in that they:
1. Failed to secure a release before agreeing to settle the recent case (critical point).
2. Admitted a legacy publicly regarding past management, of which may or may not give support to CHM's case. This letter should not have ever gone out, it gave a free kick to CHM's lawyers.
The above would also potentially cast doubt over the MMX legal representation. If they advised MMX to do what they have I would love to know why.
I have followed the case spasmodicaly up until now. I now will take a closer interest in the proceedings. Will they win or lose? That I really don't know, although this is not clear cut either way. It does seem that point one and two above has opened the way for CHM at minimum.
