1) Always possible, but I believe to mitigate this they have planned 72 holes. So I would be surprised if one of them didn't hit something potentially economic..
2) If they get to the stage of drilling 40 x 40 on Hartog, then I believe they will go for more advanced environmental permits to enable something of that ilk if not exactly the same.
Let's see what is gonna happen.
