The mining tax is supported by most Australians including some who think it does not go far enough. The asylum seeker issue was certainly cocked up by Labor and made worse during Gillard's time as leader when she came up with a variety of silly solutions. I don't know what Rudd's current plan for dealing with this issue is, but I don't think anything Labor or Liberal currently have on offer will stem the tide.
I doubt a return of Rudd to the ALP leadership would win them the election but it would IMO give Abbott a fright and end the Liberal's expectations of a landslide win. But you never know, politics is a fickle business.
