Again I would argue that Sullivan still had the suspicion that he was right regarding the Customary Law (which turned out to be true because it was the only victory he got in the CoA)
I am not saying in anyway at all there was mismanagement or ineptitude especially regarding RM (i can not make any such claim as I have never met the man)
My only points are those I have stated and should not be taken into consideration with anything else.
I would also still say though it was pretty easy to find that Sullivan was a specialist in Customary Law and well maybe this could (i say could because Lilly QC might have very well known this) have been taking further into consideration. That being said Lilly's only defence was the immediate indefensibility and well they tried that..... so not sure if anything else could have been done.
