Cheers Tombo. I totally agree that the ASLB decision is great news for PEN. But to the annoyance of many here, I refuse to gloss over or ignore germane realities. While the final outcome has now moved dramatically in PEN's favour, the threat is not over until the intervenors either withdraw their litigation or exhaust their options. We will know in 24 days whether they are withdrawing or appealing.

Whether or not the intervenors appeal will depend on the advice they receive from their legal advisors. And any grounds of appeal will focus on whether or not the ASLB have, in the view of the advisors, erred in applying the relevant rules and procedures to their conclusions on the contentions.
