Mud - good post and great to see you trying to get your head around this issue rather than just r pretending it is not happening or that it is uniportant. As I have already posted, it is far from a game breaker but it is potentially a game changer.
Just a comment about this sentence: "If projects of this nature can become unwound due to dust & light issues..."
It is far more than just "dust & light issues". They were just the issues that got the petitioners legal 'standing'.
The main game now is about the four contentions - including water quality and cumulative impacts. With standing now confirmed, the main contests will now focus on the much broader issues in the 4 contentions.
