    The AGM must be held within five months of the end of the company’s financial year, so 30 November for APG, and members must get at least 28 days notice of the meeting for a listed company. So APG are now out of time to give notice of a meeting by 30 November. But because of COVID, ASIC issued a media release yesterday which says in part:

    “ASIC has adopted a ‘no action’ position where public companies do not hold their Annual General Meetings (AGMs) within five months after the end financial years that end from 31 December 2019 to 7 January 2021, but do so up to seven months after year end.”



    So it seems APG can defer holding the AGM until 31 January 2021, and I suggest they will hold it on the last day possible so as to avoid scrutiny for another couple of months (and hold it by Zoom as sasa suggests). The media release is on the ASIC website and can be accessed from the home page.
