Heydon accused of "doctoring email"

    Is doctoring an email any different to forgery by omission?

    'Doctored document'
    The silk acting for the national construction union, John Agius, drops a bombshell. He says one of the emails between Commissioner Dyson Heydon and the organisers of the Sir Garfield Barwick address had a Word document attached which was named "state donation compliance".

    That attachment was not part of a tranche of emails released by the commission last week.

    Agius says the hypothetical observer assessing whether there is an appearance of bias in this case would have a "serious concern" as to why this attachment has only now been revealed when emails were released by the commission last week.

    Agius says that hypothetical observer would be "entitled to draw inferences ... not just from facts disclosed, but also from the fact of non-disclosure or disclosure which was of itself misleading".

    He says the observer would have concerns that there was "at best a partial disclosure", if not disclosure of a "doctored document which had been edited to remove the reference to state donation and also would be concerned about the incomplete disclosure".
