Sorry biteme but the only real debate in the legal minds is whether he was a "legal" or an "illegal" combatant. The US went for the "illegal combatant" categorisation to offshore their management and sever their call on the constitutional protections of the mainland.
A combatant, however, he certainly was. Earned him either a stint in jail or a POW camp.
