That's a common tactic and one even used by the govt. Have a look at outcomes of ASIC taking on market manipulators, retail traders go to jail because they can't afford to take on ASIC in court, brokers/insto traders/etc get off with civil penalties and no criminal conviction because they can take on ASIC in court - when you actually look at the cases you can see the retail traders playing some naughty games have very little impact on anyone else and end up in jail, the wholesale traders steal vast sums from other market participants and get off with a fine
