Yes your argument is all very logical, but taken to its extreme it would mean we shouldn't need any police or any government regulations over our lives. I think we need a balance, and I agree with you that at the moment the balance is too far in favour of strict policing and over-regulation (ie zero tolerance) particularlly in regard to personal morals and freedoms. Often times, irrational and fear driven criminalision of certain activities can have more harmful side-effects than allowing more intelligent, open and self regulatory approach.
