That "loophole" applies to ALL stocks. A 'know' flaw, but that's the way it is.
It is NOT just stocks that have been in a T/H.

Disregard the word T/H.
If a stock closes at 50 cents, opens the next day at 65 cents, then at 10:09:55
drops to 40 cents, we pay 40 cents. The latest pre 10:10 price.
You have a thing about T/Hs, but using BGS as an example,
it opened LOWER than what the T/H price was.
