Failure of a mining application to be received by Registrar when sent in time must not be looked at when deciding whether a competing application has been filed.

The relevant section is "perhaps it would be prudent that the mining registrar be telphoned several days before the expiry day to confirm whether or not the application for renewal has been recieved, and if not then the applicant should cause an application to be delivered to the Mining registrar."

The ruling is that it is up to the holder of the lease to make sure the renewal arrives on time. Case law would probably be on CAZ's side as well.

Unfortunately it was a wardens ruling and not a minister's. Given that the minister has ultimate say, a minister ruling over a similar situation would have much more status.
