    I think there is an exemption for the lender of the shares. If we assume Peter Bond is lending his shares to UBS as you say then until UBS actually sell some of those shares Peter Bonds' position hasn't changed. How would Peter Bond be expected to know when UBS dispose of the borrowed shares? That is why there is an exemption for him.

    I could be talking horse shit but I think that's how it works. Do some research.
