I read this case as rectifying a Jurisdictional error - known as a Certiorari
It had to be done by a higher court to overturn the lower courts decision.
There was no winning or losing here for the plaintiff or defendant just admin fixing up stuff is the way i read it. Doing this gave the opportunity to take these points to trial. It's in the screnshots below.
If you consider that a win well ok. To me its nothing more than fixing an issue, getting more clarification etc and giving the plaintiff a second chance, which they lost at trial anyway.
At trial all the sugar australia stuff your hanging your hat on lost. As you said JK won.
