ASIC does not disclose anything if they are currently in the middle of doing an investigation or should I say forming a case. I believe the last I got is that Mr Pham is having to wait to talk to a senior lawyer within ASIC. You can try and call ASIC Sydney since this is where Mr Pham resides. The problem you have will be a confidentiality clause that has been signed.

Its like the Peter Landau stuff in CTR and CCC. I know a few mates who put money into CCC in Perth back in late 2014, I believe this was through a share purchase plan, but then demanded their money in January 2015 and when OKAP did not refund the money in time they went to ASIC. All they were told is that their case will be looked into. In late June 2015 they just got an update that the matter is now being investigated further.

ASIC frooze Landau's assets in December 2015. As we all know Landau is in a lot of trouble however being a citizen he has the right to go to court and give his version (which no doubt he will be giving a different version). This is the sort of turn around time that is faced when you are dealing with ASIC. These guys are slow as but they have a good conviction rate.

If you want to check if Mr Pham is on the ball, I remember his call on the International Petroleum settlement was $280k. I remember myself and a few people challenged the company to detail this on an ASX announcement, and NKP verified it.

We followed up to chase where is the missing $2.5m (Settlement and Release Clause) which was supposed to be used for International Petroleum, NKP went quite. Answer is likely "Nkwe management covered up the fraud".

Wayne25 said it best, best you talk to Mr Pham directly instead of going through any third party. I think Mr Pham is currently is away on some field visit this week but he should be back in the next 24-48 hours.

I wanted to say "Its likely that Mr Pham and ASIC has likely signed some kind of confidentiality working agreement" so ASIC is likely not going to say anything.

Once ASIC makes an official move there will be disclosure on ASIC website. Refer to the Landau example.
