They lost the first case because they stuffed up and now are trying the wording trick . From memory that escape was largely killed of in previous cases
I did a search of US test cases and while early cases were lost by the policy holders its not looking good for the insurance companies in later cases
I can see why Papa Buffet cant say no losses here .
As mentioned its not the small claims as I dont think there are a lot and a US search seems to back that up . Its the big ones.
At the same time insurance companies resell a section of policies over X amount of damage payout and thats where Papa Buffet does a big chunk of business in that he pays the amount over X damages per event so he may have the biggest nightmare and why he holds that huge float that he has said is to cover 1 in 100 year events others cant cover the full cost of when it comes
Time will tell but court cases can run into years
