ABG has let both BCL and Rio Tinto completely off the hook and let it walk away from its massive liability to all Bougainvilleans. This can’t be forgotten.
Why has the ABG not sued Rio Tinto as promised?
Is it because they do not have the resources and/or if they sue Rio they have to sue BCL, as the license holder?
How can they possibly want to sue Rio or BCL once they renew their expired exploration licence and in so doing confirm BCL has duly complied with all laws and is therefore a ‘fit and proper person’ notwithstanding the past environmental damage?
The promise to sue Rio is just not credible.
Why is BCL chaired by a 30 year veteran of Rio?
Why is Mr Peter Taylor, another 30 year Rio Tinto employee attending BCL Board meetings in Buka, if Rio Tinto is no longer involved?
Why is the ex Rio appointed BCL Chairman, Peter Taylor still a paid consultant to BCL? Whose interests is he protecting – Rio?
SMLOLA Consortium will assist SMLOLA to sue Rio Tinto and BCL.
SMLOLA Consortium is in contact with US lawyers who filed the Sarei v Rio case in the US in 1997. They have agreed to assist SMLOLA and the ABG in any new action the ABG would like to take – if a compromise is not negotiated by the ABG.
ABG and PNG Governments now control BCL and could close it down and distribute the cash to Bougainville and its shareholders giving you near term access to significant cash and start with a clean slate. Instead they are trying to keep BCL alive and free from paying any compensation to the people of Bougainville.
If a compromise is achieved through mediation in September, BCL could be required to contribute to remediation sooner as well as compensate Bougainvilleans for its part in the conflict and the destruction of your lands.
The landowner/SMLOLA consortium would commit to remediation works like fixing the acid drainage issues and completing the important base line studies.
