I'm referring to the flash traders. They will move small volumes at a high frequencies to create a sense of market depth with in dark pools. The issue is that retail investors may not be getting the best price due to the preference given to flash traders.
It's not necessarily illegal but the agreements they have with the brokers/institutions needs to declared to market participants due to conflicts of interest. Though the argument of getting clients the best price might be subject to dispute also.
