Maybe you better understand the definition of "insolvency" than others - put simply, its the inability to pay debts as and when they fall due.
Missing distributions on hybrids falls into that category, notwithstanding hybrid distributions are discretionary. So is paying any debt if you're prepared to wear the consequences.
