The Full Bench of the Federal Court of Appeal today allowed Telstra's appeal and overturned the earlier judgment by Justice Graham. This means the Government will now provide Telstra with the documents it has been asking for since August last year re OPEL documentation.

PS. I think it would be highly highly unlikely that G9 (90% run by OPTUS) will get $$$ for FTTN given they have already got $1b for OPEL.
Telstra is the only real company that can build it.
All other O/S possibilities will want more Gov't funding and much better terms and conditions. I doubt the Gov't will accept this. Also, the global markets are tight for cash right now which makes the tendor process more difficult for the Gov't.
