NO i don't think a $1 bil lawsuit will change the valuation at the present time, IF it goes ahead and then IF they win, then that will impact the valuation at that time but no earlier. The escrow won't really effect the valuation either, as it is still in doubt and is proportionally miniscule compared to the size of the puncture.
New Lenders will profit no matter what, don't for a second think that they are gambling on lawsuits it would be unwise as an investor imo.
Cash flow obviously no good here as new Lenders had to create MORE super debt and capitalize interest.
