i am down 40%

I want to keep this stock in my portfolio but I am down 40% is it taxation legal for me to sell at this point in the year and buy back the same number of shares within a day or two?

After all the loss will fortify me later and any gain from my future holding in the stock will be taxable anyway.

Sick of seeing it red...better to see it green every once and a while LOL
