If the agreement had anything else of importance that was not disclosed it would need to be released to the market via the continuous disclosure provisions. This is not a grey area such as how often a company needs to prepare an updated JORC statement. It is absolute black and white! I suggest you review the Fortescue case and James Hardie case on continuous disclosure if you believe ASIC don't take the continuous disclosure regime seriously. Both those cases (with respect to continuous disclosure) surrounded not disclosing important information contained within agreements.
