Interesting, but where does this leave us:

BHP has stated previously that they will only negotiate if required to do so. Unless I am interpreting incorrectly it seems a directive without much grunt behind it....
"In a submission to the ACCC, BHP said it had no objection to the application but noted that it would probably not participate in third-party access unless required to do so."
