One thing I'm struggling with is what the motivations of Caspian are? I understand that at the time they probably thought they had a good chance in winning the case, however presumably the courts need to take into account the current viability of the company, which is now substantially different (and significantly improved).
given that, I would have thought they'd prefer to mediate outside of the courts to save costs, but instead appear to be happy to wait it out.
