John I believe that min res cannot go above a 19.9% holding unless they formally announce an offer price to take over the company. The $1.50 target getting to only 40% would be that there would not be many takers and the price would continue higher than $1.50.
if min res offered $1.50 per share they then cannot purchase above that price on market, I believe that would be the assumption of an increase to only 40%.
