dont chm hold a large parcel of mmx shares from the Evans & Koh settlement? so if chm believed it was going to win big why wouldnt chm sell its mmx shares now? if they do 'win big' the mmx script will plummet so why not cash out the mmx shares before the decision?
perhaps chm only expect to win a token cash payout (a few mill) which means mmx shares will climb instead of fall and then chm can recover at least some money by selling them at a higher price.
