The only part of the original proposal which has to be amended are some of the dates; the basic package is still in place.
It was reasonable for IFCA/Chemeq to expect Court consent to a variation of the orders to avoid delay in consideration of the rescue offer. Obviously, the origianal documentation was drafted with that expectation in mind.
For you to say it was reasonable to expect otherwise is a view justified from hindsight. The delay is only a minor setback if that. Let's wait and see when your own criteria for proclaiming the deal is dead and buried are met - an announcement from Chemeq or IFCA.
I agree that a CMQ Appeal win could (but not necessarily) be a loss, but not for the reason you give.
