They are in possession of property they do not own, property that they have taken from someone else's land and it appears there is no intention of returning it.
They only had the rights to minerals, what is left after the extraction of those minerals are tailings. The tailings are to be returned to the mine voids from where they originated.
Iluka does not own the tailings from Jennings farm.
