Iluka was fully entitled to mine and retain any zircon and ilmenite under their mining lease and the 1975 Eneabba Mineral Sands Act. Private land owners in W.A. have no claim to the minerals found on their property. Iluka's only obligation was to return the non-mineral bearing sands, which they did as part of the mining operation.
