ML173, I received exactly the same email on Friday, plus a call from Peter at Commsec several hours later. Lots of apologies and a comment thanking me for remaining calm as I expressed my displeasure, no knowledge of when this will be closed off though he did say that it was only since Thursday had the seller been able to provide the shares.
I had been rung by ASIC as well though I had to break off that conversation to return to a meeting I had been pulled out of. All I got told was that I'd have to go to the Financial Ombudsman - the analyst was clearly unaware that other complaints had been made but said he would look into it. I can't see how ASIC can fob this off though, as according to this ASX link
http://www.asx.com.au/about/complaints.htm
they are the appropriate body to investigate breaches of the Corporations Act including short selling
