    CMQ had indeed given such an undertaking to the court as a condition of being allowed to lodge an appeal.

    The hearing today is about CMQ asking the court to allow that undertaking to no longer apply.

    I think they are not in contempt because the proposal is dependent on the court giving permission. If the court refuses permission this proposal will not go ahead, and therefore CMQ will not be breaching that undertaking.
