It probably can't. Cougar's plant is not one that has degrees of operation - either they are gasifying coal, or they aren't.
It does sound like they won't be allowed to gasify coal at this stage, but we will have to wait for the details. Given DERM's history in this issue, don't expect much. They have been pathetic.
