Seems like we are all waiting on the ATO ruling that the company has requested, that should answer your questions.
If it is a dividend that wouldn't be ideal as it would encourage holders to sell to offset the income tax liability as every holder would suddenly be sitting on a potential capital loss. Of course, could always buy straight back in.
