Given that ASX have referred certain matters to ASIC, do they have any right to further information from an independent expert? ISX should oppose the motion to produce. They have told ASX enough about their business. What ASX are possibly looking for is what ASX might have discussed with CU in regard to Clearpay. NSX has other options open to it than just being a look-alike ASX, and if ISX contract to work with them on that, ASX may be wanting disclosure of that as well. The lawyers need to improve on their performance first time round, and get the message to J.Davies this is all about going beyond procedural fairness and using purported full disclosure to mean do not plan to compete.
