I am not an expert but if Luzon thought they had a case you would think they would have taken Republic to court and persued justice especially before the Vista deal expired. They did not. They did nothing and let the deal for Amayapampa come and go.
Republic in my opinion waited until the Luzon Vista deal expired and that was when it was in the prime decision to gain the Amayapampa prize as they knew all along they were in a good position to win the legal case - they took the legal case as they are confident of winning.
I feel it is simple if Luzon thought they had a case and could win the legal battle they would have taken Republic to court a long time ago and now they are clutching at straws
