Court post-tender doesn't make for good economics for either side, kinda like the old M.A.D cold war defense, you neutralize your competitor's threat but lock yourself into a frozen posture.
Perhaps something along the FMG lines would play out instead, the upstart (in this case tender loser) lobbying for more access but the main trackwork getting done in the meantime.
