Is you entire case likely to fall apart if BBI management can produce something (such as a letter / email from BAM) which indicates that they want to attribute a value to BEPPA of, say, $0.05 ?
This would make its statement re 'may assign a value to BEPPA of less that recent trading prices' to be, in fact, accurate.
And I dare say such correspondence would exist.
Of course, subsequent to this announcement, large BEPPA holders got involved, and a higher value was obtained.
But it doesnt mean that the statement was not accurate at the time (or at least as accurate as it could be). I think the sentence about 'significant uncertainty' will be a problem for you, along with your HC post that you were unwilling to hold during uncertainty.
